As artificial intelligence impacts the sector, the balance between technological innovation and copyright protection has become a central policy concern. Creative PEC’s submission to the UK Government’s AI and Copyright Consultation is available to download below.
We emphasise the need to safeguard copyright protections as a fundamental condition for the growth of the creative industries, while also carefully considering the needs for AI sector growth.
The submission addresses the Government’s preferred option of a text and data mining exception (accompanied by an ‘opt-out’ and transparency measures), raising concerns about enforceability, technical viability, and the risk of undermining creators’ and rights holders’ ability to commercialise their IP.
Our submission highlights gaps in evidence, the need for further research, and urges caution in approaches to copyright reform, advocating for evidence-based decisions that protect the creative industries.
The submission was written by Policy Adviser Nik Gunn, Creative PEC Director Prof Hasan Bakhshi and Head of Policy Bernard Hay.
